The end of the year is a great time to share the work we’ve done!

📖 We have supported the City of Tallinn and Tondi School in resolving their dispute with the State Shared Service Centre (RTK) concerning a financial correction. This has been a long-running case, which has already once reached the Constitutional Review Chamber of the Supreme Court (read more in the Public Procurement Blog).

The same dispute has now again reached the Supreme Court, which will decide whether to accept it for proceedings. However, an important interim victory can already be highlighted: the Tallinn Circuit Court annulled the financial correction imposed on the City of Tallinn, finding that the requirement for a guarantee letter from a credit institution registered in Estonia did not harm the EU budget. The Court held that cross-border participation was not excluded in the construction procurement and that foreign bidders had no actual interest in participating. The procurement also ensured strong competition.

Therefore, even if the Supreme Court decides to take the case into proceedings, it is very positive to see progress in financial-correction disputes, where courts are clearly moving—following the Supreme Court’s guidance—toward a more reasonable approach.
